Public auctions due to contractual pledge of rights pursuant to § 5 SchG Bearer check

(1) The check can be made payable:

: to a specific person, with or without the explicit reference “to order”;
to a specific person, with the note “not to order” or with an equivalent note;
to the owner.

(2) If a specific person is designated as the payee in the check with the addition “or bearer” or with an equivalent note, the check shall be deemed to be made out to the bearer.

(3) A check without indication of the payee shall be deemed payable to the bearer.

Note: The practice of pledging bearer checks, which is common in other countries, is rarely used in Germany.
