Public auc­tions due to con­trac­tu­al pledge of rights pur­su­ant to § 5 SchG Bea­rer check

(1) The check can be made paya­ble:

to a spe­ci­fic per­son, with or wit­hout the expli­cit refe­rence “to order”;
to a spe­ci­fic per­son, with the note “not to order” or with an equi­va­lent note;
to the owner.
(2) If a spe­ci­fic per­son is desi­gna­ted as the payee in the check with the addi­ti­on “or bea­rer” or with an equi­va­lent note, the check shall be dee­med to be made out to the bea­rer.
(3) A check wit­hout indi­ca­ti­on of the payee shall be dee­med paya­ble to the bea­rer.

Note: The prac­ti­ce of pled­ging bea­rer checks, which is com­mon in other count­ries, is rare­ly used in Ger­ma­ny.
