§ SEC­TION 368 HGB

pur­su­ant to Sec­tion 368 (2) HGB

1) In the case of the sale of a pledge, if the pledge is a com­mer­cial tran­sac­tion on the part of the pled­gee and the pled­gor, the peri­od of one month spe­ci­fied in sec­tion 1234 of the Civil Code shall be repla­ced by a peri­od of one week.

(2) This pro­vi­si­on shall app­ly muta­tis mut­an­dis to the sta­tu­to­ry pledge of rights of the com­mis­si­on agent, the car­ri­er or freight for­war­der, the for­war­ding agent and the warehouse kee­per, and to the pledge of rights of the car­ri­er, freight for­war­der and for­war­ding agent even if the con­tract is a com­mer­cial tran­sac­tion on their side only.
